Lawsuit Challenges Recent Procedural Changes to H-1B

By John Miano on May 4, 2018

A number of media outlets have reported on a lawsuit challenging recent procedural changes to the H-1B program. The original source of this news appears to be Axios. The article gives few details. However, other news outlets, including Newsweek , the San Jose Mercury-News, and the San Francisco Chronicle picked up on the Axios article.

There is nothing we can report on about this case yet; the documents are under seal because the attorneys made a number of errors when they filed the case. Documents were filed unsigned and they classified the nature of the suit as an appeal of an administrative decision involving a specific alien (which would be considered confidential information) rather than as a challenge to an administrative policy.

Until this is straightened out, the case documents are not available — which also means that nothing is happening with the case.
